Licensing
Please ensure that you have obtained the necessary license from Ultra Dimension Sdn Bhd (hereinafter called "UD"), before using the images belonging to UD.
Our licensed images pricing are based on several factors among others such as usage, print run, image size, scope of distribution, territory, duration of time used and at the discretion of the respective photographer's request price.
For images to be used outside of Malaysia, a separate agreement & written permission must be granted by UD.
Please contact our representative before finalizing images usage, including but not limiting to download from our website.
Rights Protected
Rights protected means you may rent the images for specific purpose, at the agreed price dependent on the various aspects among others the nature and/or the respective scope of that purpose.
The following are some terms, which are included in the "Licensing Agreement".
Limited Usage
- Limited usage is granted unless otherwise specifically stated in writing.
- Permission is only effective after the invoice being paid and no right are granted by your possession of the images or the invoice.
- All rights not granted on the invoice are specifically reserved for UD use and future disposition without any limitations whatsoever.
- The images sent to you remain the exclusive property of UD.
- All our images are intended primarily for non-exclusive use. For exclusive use, separate agreements must be made.
Responsibility Use
- You agree not to use the image(s) in any defamatory manner either by making physical changes to it, or in the accompanying text.
- You accept full responsibility for each image being used for your needs, when advising us of your choice of image(s).
- You incurs full liability for the use made of images which may require specific authorization from any third party, in regard to patent rights or copyright, or to the rights reserved for or by a legal entity and which are expressly excluded from this license.
- UD declines all responsibility relative to any use of these images, which could constitute an infringement on the rights of third parties.
- UD is not responsible to obtain permission from the owners, authorities or the like of Photos depicting of any private buildings, structures or any 3rd party's properties. Any necessary consent (if required) shall be the sole responsibility of the Licensee.
Reproduction / Modify
- To reproduction, or making of a copy, of the whole or part of a work without permission from UD, however small shall be considered an infringement.
- The right to modify the original image belongs exclusively to UD. With even if derivative work is extremely creative, permission must be obtained from UD. Manipulating and combining images in Photoshop or similar computer programs without permission creates an unauthorized derivative use.
Unauthorized Use
- Permission fee on invoice is based in good faith on the information provided by you to be accurate and true.
- In any event images used for purpose other than that indicated on the invoice or used without our permission, we shall not hesitate to commence legal proceedings to claim for, inter alia, an interim injunction to restrain any such infringement of the copyright as well as the delivery-up for destruction of all infringing copy, substantial damages and costs.
- Please do not assume that you will only have to pay the normal licensing fee, if caught using unlicensed and copyright protected images. Copyright infringement rights can carry high fines.
- Exceeding the terms and conditions on invoice shall also treated as an infringement.
- UD have the right to commence legal proceeding against the offender for images that were used, taken or source from other material(s) amongst others books, magazines, pamphlets, brochures, leaflets, flyers, newspaper, journals and/or periodicals outside of this publication. All license or consent for the usage of any Photographs belonging to UD must be acquired directly from UD.
- Please be informed that illegal reproduction of material is a criminal offence under the Copyright Act 1987 which carry a heavy penalty of fine not exceeding Ringgit Malaysia 10,000.00 for each infringed copy or imprisonment for a term not exceeding 5 years or both and for any subsequent offense, a fine not exceeding Ringgit Malaysia 20,000.00 for each infringed copy or to imprisonment for a term not exceeding 10 years or both.
Payment Terms
No rights are granted until our Invoice is fully paid.
Copyright Protection
All images used editorially must bear the credit line year, Ultra Dimension or as indicated by UD. Recognizable personalities and property are for editorial use only.
